Terms of Service

These terms govern your use of perfectgardens.com and any purchase you make here. By placing an order you agree to them. Perfect Gardens is operated by LISM LLC, a Wyoming limited liability company.

Who can order

You must be at least 18 and legally able to enter a contract. By ordering, you confirm the information you give us is accurate and the payment method is yours to use.

Products and descriptions

We work to describe products accurately, and much of our catalog comes from manufacturer and distributor data. Specifications, packaging, and images can change without notice, and colors vary between screens. If a product arrives materially different from how it was described, that's on us — contact us and we'll sort it out.

Availability isn't guaranteed. Stock moves, and an item showing as available may sell out before your order is processed. If that happens we'll tell you promptly and refund or backorder as you prefer.

Pricing and errors

Prices are in US dollars and can change without notice. Despite our best efforts, a product may occasionally be listed at an incorrect price. We reserve the right to cancel any order placed at an obviously incorrect price, even after the order is confirmed. If that happens you'll be refunded in full, promptly, and we'll tell you why. We won't quietly ship a different item or charge a different amount.

Orders and acceptance

Your order is an offer to buy. We accept it when we ship. We may decline or cancel an order — including for suspected fraud, a shipping address we can't verify, quantities that look like resale rather than personal use, or products we can't lawfully ship to your location.

Payment

Payment is taken at checkout through Shopify Payments. We don't store card numbers.

Sales tax

Applicable sales tax is calculated and shown at checkout based on your shipping address and our registration obligations in that state. Where we are not required to collect tax, you may still owe use tax to your own state — that obligation is yours, not ours.

Shipping and delivery

We ship within the United States only. Shipping costs, timing, and how orders are fulfilled are set out on our Shipping page, which forms part of these terms. Delivery dates are estimates, not guarantees.

Returns

Returns are governed by our Returns & Refunds page, which forms part of these terms. Please read it before ordering — equipment terms differ from our own-brand products, and restocking fees apply to some returns.

Subscriptions and memberships

If you sign up for a subscription or membership, you authorize recurring charges to your payment method on the schedule shown at signup, until you cancel. We'll tell you the price, the billing interval, and how to cancel before you commit.

You can cancel at any time through your account or by contacting us. Cancellation stops future charges; it doesn't refund charges already made or shipments already sent. If pricing changes we'll notify you before the change takes effect.

Reviews and content you submit

Reviews, photos, and comments you submit remain yours, but you grant us permission to display and use them in connection with the store and our marketing. Don't submit anything that isn't yours, isn't honest, or is abusive. We may remove content that breaks those rules.

Growing advice and product use

We share growing information freely — in videos, articles, and conversation — because that's who we are. It's general guidance, not a guarantee of results. Growing outcomes depend on conditions, technique, and factors nobody controls.

You are responsible for using products safely and lawfully. Follow all manufacturer instructions and label directions, particularly for electrical equipment, plant-protection products, and anything requiring installation. Registered pesticides must be used strictly according to their label, which is a legal requirement, not a suggestion.

You are responsible for ensuring anything you grow is lawful where you live.

Warranties

Manufacturer warranties apply to equipment we sell, on the manufacturer's terms and for their stated periods. We'll help you open and pursue a claim, but we don't control the outcome.

Beyond those warranties and what the law requires of us, products are sold as-is.

Limitation of liability

To the extent the law allows, our liability for any order is limited to the amount you paid for it. We aren't liable for indirect or consequential losses — including lost crops, lost profits, or lost time — arising from products, delays, or information on this site.

Nothing here limits liability that can't lawfully be limited.

Intellectual property

The Perfect Gardens name, logo, site content, photography, and product formulations are our property or used with permission. Manufacturer brands and images belong to their owners. Don't copy our content for commercial use without asking.

Accounts

If you create an account, keep your password secure. You're responsible for activity under your account. Tell us promptly if you think it's been compromised.

Third-party links

We link to outside sites, including our YouTube channel and manufacturer pages. We don't control them and aren't responsible for their content or practices.

Governing law

These terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts serving Wyoming.

Changes

We may update these terms. The version posted when you place your order is the version that governs it.
